Reflectors

The Government of India, in its notification GSR 5944(E) dated 12.11.08 has stated that Rule 104 of Central Motor vehicles Rules 1989 has been amended so that the Reflectors has to be fixed in the vehicles and it has become mandatory.

The following are the specifications .

The Goods vehicles which are registered on and after 1.4.2009 shall be fixed with reflectors .

The passenger vehicles including Autos, Taxis, buses, maxicabs shall be fixed with reflectors which are registered on and after 1.10.2009.

In other words it means when a vehicle is brought for registration, the fixation of reflectors are must.

The Transport Commissioner in his letter No. 52738 /H2/ dated 30.10.2009 has also communicated the above notification.

Omni Buses - Enter the Eng. No and Ch.No.

To prevent tax evasion and illegal operation of omni buses the Transport Commissioner Chennai has suggested that the engine number and the chasis number of the vehicle must be entered in the permit and the permit details must be entered in the Registration Certificate of the vehicle.

The Regional Transport Officers, in whose offices these DCB Registers are maintained for omnibuses shall enter the above detail.

So that the engine number and the chasis number could be easily verified in case of doubt and there would be less chances of interchanging the vehicle and also the same number displayed in several vehicles.

Though most of us know the Motor vehicles Rules, the relevant Rule fails to come to our active memory suddenly.

So a glimpse of certain important provisions in the Act and Rules.

1. Helmet Must: Section 129 of M V Act.

Fancy Numbers.

The Government have reserved 96 Fancy Numbers that have to be allotted by the Government in G O. Ms.209 Home Dated 27.1.90.

When a Registration serial is nearing completion, we may found there are many numbers in the Reserved category that were unallotted like 11,111,1111, 6666 7777, etc.

In such cases what to do?

The Government have issued clear guidelines in this regard in G O. Ms. 890 Home Dt 27.5.92.

Transport Commissioner has also issued a circular No.106/92 in this regard.

The unallotted fancy numbers which were reserved by the Government should be allotted in the ascending order after exhausting all the numbers in the current series without collecting any fee for the advance number and only on allotting the unutilised numbers the next series can be started .

A question may arise as to whether any number which is not reserved by the Government can be allotted in the next series before completion of this current series.

The Reg.Authority can allot in next series even before completion of this current series if the number sought for comes within 1000 numbers.

For eg. if in a particular office The series A is nearing completion and already the number 9546 has been allotted in the routine way, the Authority can allot in B Series up to 0545 , provided if the number is not reserved by the Government

N.P.Concessional rate for Multi axle vehicles

The composite tax payable by this State vehicle for other States is Rs.5000/- In case of multi axle vehicles, the tax is paid with a concession i.e. 25% less then the usual Rs.5000/- which means Rs.3750/-

The Transport Commissioner has issued a circular in this regard in the year 1998 namely 32 / 98 in which it is informed that concessional rate of tax of 25% is allowed for multi axle vehicles for other states if other States too reciprocate this.

If the other State also allows 25% concession for multi axle vehicles of our State, then the same can be extended to other States .

The Transport Commissioner in his letter No. M2/67895/09 dated 18.12.2009 has again reiterated the same and has informed that for Karnataka State also this concession applies. So if a vehicle of this State has got authorisation to ply in Karnataka State then Rs.3750/- is enough if it is a multi axle vehicle .

Driving School permit - Transfer.

Transport Commissioner, Chennai has issued a circular viz. 25/09, in which it has been pointed out that after the death of the owner of a driving school , the licence granted to the owner could be transferred to the legal heirs.

The circular further states that if the legal heir fulfils the qualifications as laid down under Rule 24 of the Central Motor vehicles Rules, then there is no bar in transferring the licence to the legal heir.

The High Court Chennai in its judgement in W P no. 29797/08 has observed that the Licensing Authority shall examine the claim of the legal heir , and if the legal heir fufils the qualifications, then the licence could be transferred.

So the Authority which granted the licence could consider if such a request comes to them.

The points for consideration is
a. What is the fees to be collected for such a transfer. Since no fees is prescribed for transfer, we have to collect the fee prescribed for issue of licence.

b. Whether the school should be as per new guidelines. Not necessary . We are not issuing any new licence. We only transfer the existing licence. So new guidelines will not be applicable.

A Better India - A Better World

You may all know Narayanamoorthy, the founder of Infosys. He has given lectures in all the leading colleges and has written several books.

His recent book is A better India A better World.

In this book he suggests six important points for youngsters to achieve greatness.

The six points are


1. Be trustworthy. If you do anything, with whomsoever you move, be trustworthy. Suppose you say that you would come to office only at 11.00. do come at the appointed time . If you come late in the afternoon, your boss may not believe you. Suppose you say to your wife that you would take her out, fulfil it without lame excuses. So be trustworthy. When some one loses confidence in you, that is all, no responsibility would be entrusted to you. We may lose lot of things when we are not trustworthy.

2. When you enter into a new deal naturally fear will crop up. Do not take it lightly. Brood over it, over come the fear and do the needful to accomplish it.

3. Never discard your family for your work. Whatever be the work, spend time with your family. Home is not a boarding place, just come, eat and sleep. You spend some time daily with the aged mother, lovely wife, wonderful kids. listen to them. Share the jokes, appreciate them, say thank you to your wife for the wonderful food. See the change in life.

4. Always do not bind you with your work. There is something more than work in life. Smile at friends, talk to them, spend time with them. When we fall down, we need some shoulders to rest. So give importance to work, at the same time take care of your family, relations, friends.

5. Try to control your feelings. Never express your anger to anyone. That will not only damage your reputation, but spoil your relationships, and we may create new foes in our field. You have to control yourself.If you want to administer an office,

6. It is true earning money is important. But that is not the be all and end all of life.You are only a temporary owner of the money you have. Try to use the money to educate a poor relative, a boy with no means may be given fees for school or college. Then the money is better spent.

Infosys company started by Narayanamoorthy has several foundations spending crores of rupees for the welfare of down trodden people.

Autorickshaws - Seating capacity.

The Government have introduced an amendment to Rule 309 of Tamil Nadu Motor vehicles Rules 1989 in G O Ms No.328 Home Trans.V dated 7.3.2008 regarding seating capacity for Autorickshaws.

The amendment is as follows:-

Provided further that for the purposes of these measurements for seating room of an Autorickshaw 5 children upto 14 years shall be reckoned as 3 passengers.

So at the time of granting permit we have to mention in the seating capacity column three passengers or five children up to age of 14 years.

Cancellation, Suspension of Dri.Licence.

When a Driving Licence can be suspended or cancelled.

What are the relevant rules for this?

Sections 19,20,21 and 22 of Motor vehicles Act deals with this.

Section 19 deals with the powers of Licensing Authority to disqualify a person for a particular period from holding a licence or revoke a licence for the offences noted in the same section and also in Rule 21 of Central Motor vehicles Rules.

Section 20 describes the powers of the Court to disqualify a driver for a particular period from holding a driving licence.

Section 21 describes when a licence can be suspended.

Section 22 contemplates the effect of conviction of a driver in a court of Law.

The nuances of Section 21 and 22 should be understood carefully.

If a driver is involved in a fatal accident his licence should be suspended for SIX MONTHS AUTOMATICALLY.

Likewise if a driver is involved in a fatal accident and if his licence has to be returned to him after the period of suspension, before the licence is returned the driver must undergo a driving test and pass the same. Only if he passes the test, the licence could be returned. See the proviso under Section 22(3) of Motor vehicles Act.

Cancellation of Registration.

Suppose if we came to know that a person has obtained a Registration Number by producing fake registration papers what to do?

Section 55 of Motor vehicles' Act 1988 provides relief for all such acts.

The Registration Certificate can be cancelled on the following grounds:-

a. If the vehicle is fully dismantled, scrapped and unfit for further use.
b. If the vehicle is removed to a foreign country once for all.
c. If the Registration certificate is obtained by production of false records or the numbers in the
engine or chasis varies with that of the records produced.or found to be tampered.

WHO CAN CANCEL:- The Authority who originally registered the vehicle can cancel the R.C.If the papers for cancellation are received by some other authority, the papers should be forwarded to the original authority for the cancellation process:

HOW TO CANCEL It has three steps
1. Inspection of vehicle
2. Notice to the owner informing the proposal for cancellation
3. Cancellation

Police Certificate - Where to Apply.

The Transport Commissioner, Chennai has issued instructions regarding obtaining police certificate for Re.Registration and for issue of No objection Certificate in form 28 for vehicles to move to Other States.

Transport Commissioner in Letter No. 59541/H2/2009 dated 11.11.2009 has instructed that police verification report should be obtained only from
State Crime Records Bureau
Santhome
Chennai 600 028.

The above office alone is vested with powers to issue Police certificate.

In other words it means that we should not address local Superintendent of Police or Inspector of Police of local stations for issue of police certificates.

Transfer of Ownership.

Whenever an application for transfer of permit is made, both the buyer and seller must sign before the Authority.

The Authority should satisfy himself about the genuiness of the seller by verifying the photos of the RC/Permit etc.

The Transport Commissioner has issued a circular No.51/2003 in this regard. Rule 211 of T N M V R 1989 allows this.

The salient features of this circular are
a. That it appllies for transfer of permit.
b. Personal appearance is must.
c. Signing before Notary public is not permitted.

The other points in this matter are
1. After allowing the transfer of permit application if the applicant could not produce the records within the perriod but subsequently wants to effect the transfer, that can be permitted by collecting the fees.(Transport Commissioner memo No. 72144/E2/83 dated 29.11.1987)

2. If one of the parties wants to drop further proceecedings without effecting transfer, that can be permitted and the same should be informed to the other party . Rule 212 of TNMVR.
