Joint Accounts.
One of the wisest things we have to do is, that whenever we open an account we should open it in a joint name, that is to say in the name of yourself and your wife or your mother etc.
This will avoid the problems that may arise in some tragic event. We should also inform our partner about the joint account.
But there are some salient features while investing.
1. Never trust anyone including close relatives, as they may be change their color at any times.
2. Never give the amount or bank challan or ask any unknown persons like helper to visit the bank. The transactions must be do it yourself exercises.
3. Do not boast about yourself. Everyone know about ourself only through us. Not through other means. Keep shut about yourself.
4. Do not keep all the eggs in one basket. Have several banks, several means to invest.

Pension plan.
Many of the Government servants think that they can get pension, a decent sum, and therefore there will not be any problem once they attain 58 years.
Sorry. You are totally wrong. At the time of retirement your pension and other benefits are merely pittance compared to, to-day's life style.
If it is a decade earlier, it may be true. But in this day, it is far from true.
So if you are not prudent enough to save for the rainy day, you will be in tantrums.
Forget about the government pension. Let it come, we will make other pension plans right from today.
All the government institutions offer pension plan. You have to invest regularly like 2500 or 5000 in the pension plan account, which is available in all the banks. Visit several banks, have the brochures, think for yourself and invest in one of the banks or other government institutions.
If you invest regularly, you will be starting to get minimum 10000/- from the month of your retirement age. You will be getting the pension till your life time.You need not invest any money after 58 years. You will be only getting money. Depending on your investment today you may get pension even 25000 per month or more.
Now in India, the life expectancy is 85 years. It may increase to 90 years in a decade. So even if you retire around 60 years you have to spend for another 30 years where as in the remaining 30 years after retirement we have to spend, and there is no chance to earn.
So invest in a pension plan.

Life insurance means your life is insured for a certain sum, in case, touchwood, if any things happens to the insured, the company pays the total sum to the nominee. This requires quarterly, half yearly or monthly premium to be paid. Depending on your age you can take insurance for 10 lacs, or 25 lacs.
Medical insurance caters to your unexpected ailments. You can have medical insurance for yourself, your wife, your kids etc. Though Government servants are covered by Star Insurance, this is an another type of insurance which requires premium and which take care of us in cases of sudden illness.

P P F and G P F

You may be subscribing to GPF. You must increase the subscription to 25% of your gross income per month. Suppose if you receive 20000 as gross salary increase your subscription to 5000 per mensem. Increase it by 1000 every two years. So if you are 30 years now and if you start saving in G F as told above, you will be getting not less than 35 to 40 lakhs while you quit service. If you are shrewed you should be following the reinvesting theory. As and when your GPF subscription reaches five lacs please withdraw 50% and reinvest in an instrument which gives more than 8% interest like LIC money plus, Birla's scheme, or TATA AIG Insurance which are as safe as Government instruments.
By this you not only repay your GPF loan but also you save a portion of this.

The Eighth Wonder.
You know what is the 8th wonder of the world?
It is the power of computing. In other words it is the compound interest that banks and financial institutions pay to us when we invest money with them.
For eg. if you are 25 years and if you start investing Rs.1000/- per mensem, at the age of 55 you will get Rs.30.8 lakhs.
On the other hand if you are 35 years and if you start now, your net return at your 55th year will be Rs.9.19 lakh.

We have to evolve a S I P a systematic investment plan. One such plan is put some money in a R D account in a bank or post office. R D means recurring deposit.
We can make a minimum investment of Rs.l000/- for a period of five years or ten years .
We can instruct the bank where we receive our salary to credit the amount from your salary every month, to a R D account . It will help you to avoid the monthly visit to the bank. The bank will automatically debit the sum from your salary.
Or we can have two or three RD accounts in the name of wife, son or daughter according to our earning and saving capacity. It will have more useful results.
What to do after the RD matures? Convert it as Fixed deposit . So if you are in your 30th year and you invest in RD continuously up to your retirement, you will receive your maturity in your 35th year, 40th year, 45th year, 50th year and your 55th year. So you will have five FD accounts at your ripe age.
Continuous flow of drops of water will fill the bucket very quickly.
For some obvious reasons some people might forget to withdraw their salary in banks every month. Never do that. This is a dangerous thing. Whether you need the money or not, we should withdraw the money immediately and we may reinvest in something . It will avoid lot of problems in the long run.

Gold - A real boon for middle income group
Most of the Government servants come within the category of middle income groups. It means that our income and expenses account tally and left with meagre amount to save.
But we have to save for the rainy day. Now it is estimated that in an average people live up to 85 long years. The life expectancy has increased sharply. So after a certain period our flow will totally stopped. Then we have to live only on the source that is with us.
One of the best form of investments is Gold. Yes. But we need not invest in the form of ornaments. We may have the option of investing in the form of coins which are available with the jewellery shops.
Count your period up to retirement. If you are in the middle of your 30s then you will have another 25 years of service. 25 years means 300 months. From this month onwards if you can buy one or two grams of coin according to your saving capacity, then you will have around 500 grams. This computation is made with the hope that in some months you may be able to buy, or not , you may be able to increase the volume of total grams you are investing.
After 25 years 500 grams means multiply it with 12000. That is what the financial planners hope for the price of gram of gold in 25 years. You will have a fortune in your hand.

Art of Investing.
Now a days there are alluring advertisements. We see lot of new things coming in the market. So if we view television, newspaper, we see lot of products coming in the market and it makes us to buy something or other . In the end if we look at everything in our home, we are stunned to see lot of products are lying idle.
So these are the things that are not really necessary for a living. But we buy and lose money.
Why so?
This is a problem with every human being. It is called obsessive buying . Whether we need a produce or not, we buy because we are lured by what others say. For eg. if you have a good l.c.d. t.v. your friend says go for l.e.d television which have better features. Even without realizing the differences, immediately we go in to buy l.e.d television. The L C D television which we bought for 35000 is taken back for Rs.5000/- and the l.e.d. television costs a fortune. When we go and install the t.v. in our home, we see the same picture, the same clarity.
So we have to set our priorities right now.
How to invest in fruitful ways. We will be writing a series of notes in this blog about the art of investing starting from to day.

Fee for conductor's Licence.
Quite often we have the doubt what is the fee for conductor's licence.
Section 30(5) of Motor vehicles's Act 1988 specifies the fee for conductor's licence as that of one half of that of driving licence. In other words 50% of the fee for driving licence is to be charged for conductor's licence.
There are several types of driving licence and the fee varies. For eg. the fee for licence in smart card is different and the fee for licence in ordinary book form is different. The fee for driving licence in form 6 i.e. in the book form is Rs.40/- as per Rule 32(2)of C.M.V.R.1989. As we issue conductor's licence in book form 50% of what is specified in Rule 32(2) is to be charged. If we issue conductor's licence in laminated form or smart card then the fee as mentioned in Rule 32(3)applies. Likewise the fee for renewal is 50% of what applies to driving licence.

Speed Regulators.
The Tamil Nadu Government have recently introduced a new regulation for the educational institution vehicles.
This applies not only to the vehicles owned by the educational instituitions, but also to vehicles used to ferry students like maxi cab, taxi, omni buses engaged by schools.
This new Government order 563 dated 10.6.2010 says that speed regulators are mandatory for all educational institution vehicles. Vehicles which are to be registered after 10.6.2010 must have the regulators now itself, and other vehicles which were already registered must have the same within 6 months.
The vehicles should be pasted with a sticker in the front and rear windscreen indicating that speed regulators are fixed in the vehicle, in both English and Tamil.
For those vehicles which are not fitted with speed governors, within the stipulated time, we may initiate action under Section 117 of the Motor vehicles' Act 1988.

An interesting case.
Recently an interesting case has come up before the RTO. This is illuminating and interesting and informative.
A lorry owner who owns a lorry registered at Tirunelveli has approached the RTO in the area where he resides for cancellation of H.P.Termination for his Tirunelveli Registered vehicle. The RTO promptly returned the application with the endorsement to submit his application before RTO Tirunelveli because the hire purchase agreements generally get terminated with the original Registering Authority.
The owner who went to RTO Tiruneveli has returned with the endorsement that the hire purchase agreement has to be terminated with the last registering authority.
There is another problem in this case. The form 35 was not signed by the financier.
The financier has refused to sign stating that the owner still owes dues. But the owner has filed a petition before District Munisif and got an order of mandatory injunction that the financier has no dues to be settled as per the accounts produced and if he fails to discharge his obligation by not sigining the form, the RTO can cancel the h.p. agreement even without the signature of the financier in view of the fact that the dues has been settled.
This is one of the reasons why RTO Tirunelveli has hesitated to cancel the same.
Now the ball is in the court of RTO and he wants to decide the case. His request for the opinion from the Government Pleader is in favour of the owner.
When the note from the office was circulated to RTO , the RTO wrote inthe note as follows.
1. In view of the District Munisif's order there is no need for the financier signature in the form 35.
2. Central Motor Vehicles' Rules allows the last Registering Authority to cancel the hire purchase agreement .
So the relilef needed by the owner of the lorry has been given.

What about one day course.
For renewal of driving licence of heavy vehicles, one day refresher course certificate is essential.
In as much as the circular no. 43/2007 has been given effect to, the driving school which complies the circular instructions as enshrined in 23/2009 are alone competent to run the school.
In the event, the certificate must be issued by the school which has been authorized by the RTO that the school complies with the relevant provisions of circular instructions are alone competent to issue certificates and others are not.
So at the time of renewal of heavy driving licences,the certificate must be only from authorised schools.

ARE WE FIT TO BE PARENTS?
My learning on people started in IIPM classrooms... in classes of Dr N R Chatterjee and Dr J K Mitra – both ex Deans of FMS Delhi, my gurus, gods of psychology and great human beings. Their classes made me so mesmerised that though I took finance as my elective, I attended all classes of HR too and became a very keen student of psychology and behavioural sciences. With time, this took me beyond classroom books to the world of Eric Berne's Transactional Analysis to books like ‘Born to Win’ to the world of Sigmund Freud and Karl Jung. At one point of time in my life, I went so much into this that I ended up reading semimedical books like abnormal psychology etc! After I became a leadership trainer, the learning only kept growing. But all that was nothing till my son, Che, was born in the year that marked the beginning of the new millennium!
It’s been almost ten years now and the human behaviour I have focussed upon most during this decade has been child behaviour. I have since then almost raised four kids. No, they aren’t all mine! But one can find me oft en with them in my free time – Che and the three other kids of my three friends! And I hope I have been raising them happily to become happy kids! Today, speaking on kids – how to bring them up – in informal and formal forums like schools etc has become one of my favourite topics, simply because the more I see parents around me – stressed and successful – the more I see their kids going wrong! I will share here only a few key things which decide if we are fit to be parents and raise happy kids or not.
I have seen we mostly bring up kids without realising that this is our biggest contribution to this earth and its well being. The kids who had a grandfather who always told them that one day they will become Presidents of the USA and gave them that confidence from their early childhood actually went on to become John F Kennedy and Robert Kennedy. At the same time, the kid of the boy from an abusive family with constant negative reinforcements went on to become Lee Oswald, the man who murdered John F Kennedy. What I am trying to say is that we are the ones who will decide if tomorrow’s world will be a happy world or a sad world. Children are what we make of them. Today, science has also proven beyond all doubts that genes decide less than a percent of human beings psychology. It’s their upbringing that decides it. Genes only determine various biological aspects inside the body, and not psychological. Neither does a kid become great because of genes nor useless because of the same. We make what a kid is to become; so we parents – and to some extent teachers – are wholly responsible for what he becomes.
That brings us to the point: So what should we do to bring up great kids and become worthy of being parents? Well, if there is just one thing we must believe in and we must tell our kids – and I have always told all kids – it is, “Love is more important than material things.” It is almost like the magic potion for happiness. We need to believe “passionately” that love is more important than any material item in this world. If we don’t believe in it but tell our kids the same, one day they will question us about why we’re not following the same philosophy we preached. And all the teaching will go waste. But once you believe in it passionately, things will all be different. You just have to keep explaining this to your child from the age of 6 months – only this simple line. And before 6 months? Just love him endlessly through physical touch and positive reinforcements and smiles. That’s our only job as parents.
But what about the daily problems of your kids doing some things that are not right? Well, every time the child does something you don’t want her to do, your only job is to explain the same with a smile and friendly manner – whatever be the age of the child. A child’s life has to be necessarily full of positive strokes and “adult to adult ego state” conversations on every topic of importance. An adult to adult ego state conversation is where we don’t use either our “parent ego state” of making authoritative sweeping statements without feeling the need to clarify to the child, or the “child ego state” displaying excessive emotions of any kind. So, it’s a conversation which is based on talks, facts and logic but explained sweetly. This is the only solution to all our issues of how to handle problems. Whenever a child knows that the parent has endless time to explain things and is free of any fear of being admonished, he expresses himself freely and then listens invariably to what’s logical – just because he feels respected and loved. And it has never ever failed to work in my last one decade of bringing up the four kids!
One might immediately question, what happens when a kid gets adamant and throws a tantrum and starts crying? Well, kids are too intelligent. They do that only when they know it succeeds! So the best way is to again take the kid in an embrace and tell firmly that whatever he wants, he will not get, however much he cries.
But that doesn’t mean that you love him any less. So as long as he cries, you will keep loving him, but won’t allow him to do what he wants. The kid will cry louder, will try to force himself to freedom, but all you have to do is just embrace the kid, let him cry and constantly tell him that the more he cries, the more you would love him – because you really do love him. And then tell him that though you feel bad when he cries, he still would not get his way ever with adamancy, and that once he finishes crying, you will both talk logically on why you can’t let him do what he wants to. Or buy what he wants to. And constantly remind the child that love is more important than anything else in the world. So, if it’s a toy the child is asking for, the point to be made is that love is more important than the toy and that the kid will get all the love in the world but not the toy, as there are too many kids in the world whose fathers don’t love them as much, but give them lots of toys – tell your child that he surely doesn’t want to be in that kind of a home. The child starts realizing the logic sooner than you can imagine. Almost the first full sentence all the kids around me ever said was, “Love is more important than toys.”
So that brings us to the biggest mistakes we make as parents! Well, the single biggest mistake we make as parents and teachers is to physically hit a child. The softest of slaps is absolutely unwarranted and damaging. You hit a child and you have laid the foundation stone of a future road-rage protagonist. And it’s the biggest unacceptable shame for any parent or teacher. There is absolutely “NO JUSTIFICATION FOR IT.” Parents try to justify it by saying that they are so stressed, and at times, hitting is the only way out. Nothing is a further farce. Your love for your child is actually so less at that moment that you actually take a shortcut to set things right. And this is one shortcut that is most costly in life. A child is the strongest creature possible. A child can tolerate any amount of your hits, till he is alive. And he gets used to it. It only alienates the child further, makes him more adamant and resolved to repeat the same; and damages his psychology forever. Or else, it makes him most meek and ruins his personality. And we want neither. On an extreme end, the more a child is from an abusive family, family of drunkards, broken families, the more the possibility of him landing in a jail one day. For all studies on criminals show only these common traits. So, the saying ‘spare the rod and spoil the child’ couldn’t be more wrong. But that doesn’t mean you should let your child do anything he wishes to. As I said, you have to make him do the right things through love and explanation. And for that, you have to believe love is the most important thing in life. If you do, you will have all the time and patience to shower love on your child and explain things to him.
The second most common mistake parents do is misbehaving with the child; and then out of guilt, buying him gifts. Do that and you have taught the child just the opposite of giving love the maximum importance. It means gifts and material things are more important. And he will learn to value love by toys. No child around me knows me for giving them gifts. However, they do know me for loving them the most. And I can assure you they love me more than their other gift giving uncles! In fact, despite my fervent requests to all my friends to get only love and no gift s on Che's birthday, they end up getting gifts. But they must know Che doesn’t get them. Che, me and Rajita (my wife, who does everything exactly the way I am writing, and more, as I will explain later) have a pact that he will get to keep gift s of only six of the most important people in our lives – as they love him too much and their gift s are what he wants as they’re chosen with lots of thought and they keep giving him love throughout the year. He could choose any four other gift s out of the rest of the gift s and also all the books he gets. In turn, he has to give away to our Great Indian Dream Foundation kids, double the number of toys! He loves the arrangement. Now he waits for every birthday, more to go and give than to get. The same rule applies to every toy he wants us to buy for him. If we agree, he has to give away two! And you bet it makes him more humane and loving.
The final big mistake parents do is make statements like, “I spend quality time.” Well, the truth is there is nothing called quality time for a child. The only thing that the child understands is “quantity time.” Yes, there will be times when one of you will be busier and you must therefore spend a great Sunday with him. But you can’t become weekend parents in the name of quality time. Because then, the people whom he spends quantity time with will decide what he becomes and not you. And that’s taking a huge chance unless you know that those are people with the values I just spoke about.
I would want to sign off by saying when my best friend had a daughter, I told him to immediately get his father to stay with them. If grandparents are alive, that’s the best gift for your kid. Staying with them, children learn how to be more considerate in life; and you again realise the importance of your parents in your life. That’s the real test to find out whether we’re fit to become parents... for to be good parents, we got to become good children first. I wish lots of love and a life full of happiness to all my readers, their parents and their children.

ARE WE FIT TO BE PARENTS?
My learning on people started in IIPM classrooms... in classes of Dr N R Chatterjee and Dr J K Mitra – both ex Deans of FMS Delhi, my gurus, gods of psychology and great human beings. Their classes made me so mesmerised that though I took finance as my elective, I attended all classes of HR too and became a very keen student of psychology and behavioural sciences. With time, this took me beyond classroom books to the world of Eric Berne's Transactional Analysis to books like ‘Born to Win’ to the world of Sigmund Freud and Karl Jung. At one point of time in my life, I went so much into this that I ended up reading semimedical books like abnormal psychology etc! After I became a leadership trainer, the learning only kept growing. But all that was nothing till my son, Che, was born in the year that marked the beginning of the new millennium!
It’s been almost ten years now and the human behaviour I have focussed upon most during this decade has been child behaviour. I have since then almost raised four kids. No, they aren’t all mine! But one can find me oft en with them in my free time – Che and the three other kids of my three friends! And I hope I have been raising them happily to become happy kids! Today, speaking on kids – how to bring them up – in informal and formal forums like schools etc has become one of my favourite topics, simply because the more I see parents around me – stressed and successful – the more I see their kids going wrong! I will share here only a few key things which decide if we are fit to be parents and raise happy kids or not.
I have seen we mostly bring up kids without realising that this is our biggest contribution to this earth and its well being. The kids who had a grandfather who always told them that one day they will become Presidents of the USA and gave them that confidence from their early childhood actually went on to become John F Kennedy and Robert Kennedy. At the same time, the kid of the boy from an abusive family with constant negative reinforcements went on to become Lee Oswald, the man who murdered John F Kennedy. What I am trying to say is that we are the ones who will decide if tomorrow’s world will be a happy world or a sad world. Children are what we make of them. Today, science has also proven beyond all doubts that genes decide less than a percent of human beings psychology. It’s their upbringing that decides it. Genes only determine various biological aspects inside the body, and not psychological. Neither does a kid become great because of genes nor useless because of the same. We make what a kid is to become; so we parents – and to some extent teachers – are wholly responsible for what he becomes.
That brings us to the point: So what should we do to bring up great kids and become worthy of being parents? Well, if there is just one thing we must believe in and we must tell our kids – and I have always told all kids – it is, “Love is more important than material things.” It is almost like the magic potion for happiness. We need to believe “passionately” that love is more important than any material item in this world. If we don’t believe in it but tell our kids the same, one day they will question us about why we’re not following the same philosophy we preached. And all the teaching will go waste. But once you believe in it passionately, things will all be different. You just have to keep explaining this to your child from the age of 6 months – only this simple line. And before 6 months? Just love him endlessly through physical touch and positive reinforcements and smiles. That’s our only job as parents.
But what about the daily problems of your kids doing some things that are not right? Well, every time the child does something you don’t want her to do, your only job is to explain the same with a smile and friendly manner – whatever be the age of the child. A child’s life has to be necessarily full of positive strokes and “adult to adult ego state” conversations on every topic of importance. An adult to adult ego state conversation is where we don’t use either our “parent ego state” of making authoritative sweeping statements without feeling the need to clarify to the child, or the “child ego state” displaying excessive emotions of any kind. So, it’s a conversation which is based on talks, facts and logic but explained sweetly. This is the only solution to all our issues of how to handle problems. Whenever a child knows that the parent has endless time to explain things and is free of any fear of being admonished, he expresses himself freely and then listens invariably to what’s logical – just because he feels respected and loved. And it has never ever failed to work in my last one decade of bringing up the four kids!
One might immediately question, what happens when a kid gets adamant and throws a tantrum and starts crying? Well, kids are too intelligent. They do that only when they know it succeeds! So the best way is to again take the kid in an embrace and tell firmly that whatever he wants, he will not get, however much he cries.
But that doesn’t mean that you love him any less. So as long as he cries, you will keep loving him, but won’t allow him to do what he wants. The kid will cry louder, will try to force himself to freedom, but all you have to do is just embrace the kid, let him cry and constantly tell him that the more he cries, the more you would love him – because you really do love him. And then tell him that though you feel bad when he cries, he still would not get his way ever with adamancy, and that once he finishes crying, you will both talk logically on why you can’t let him do what he wants to. Or buy what he wants to. And constantly remind the child that love is more important than anything else in the world. So, if it’s a toy the child is asking for, the point to be made is that love is more important than the toy and that the kid will get all the love in the world but not the toy, as there are too many kids in the world whose fathers don’t love them as much, but give them lots of toys – tell your child that he surely doesn’t want to be in that kind of a home. The child starts realizing the logic sooner than you can imagine. Almost the first full sentence all the kids around me ever said was, “Love is more important than toys.”
So that brings us to the biggest mistakes we make as parents! Well, the single biggest mistake we make as parents and teachers is to physically hit a child. The softest of slaps is absolutely unwarranted and damaging. You hit a child and you have laid the foundation stone of a future road-rage protagonist. And it’s the biggest unacceptable shame for any parent or teacher. There is absolutely “NO JUSTIFICATION FOR IT.” Parents try to justify it by saying that they are so stressed, and at times, hitting is the only way out. Nothing is a further farce. Your love for your child is actually so less at that moment that you actually take a shortcut to set things right. And this is one shortcut that is most costly in life. A child is the strongest creature possible. A child can tolerate any amount of your hits, till he is alive. And he gets used to it. It only alienates the child further, makes him more adamant and resolved to repeat the same; and damages his psychology forever. Or else, it makes him most meek and ruins his personality. And we want neither. On an extreme end, the more a child is from an abusive family, family of drunkards, broken families, the more the possibility of him landing in a jail one day. For all studies on criminals show only these common traits. So, the saying ‘spare the rod and spoil the child’ couldn’t be more wrong. But that doesn’t mean you should let your child do anything he wishes to. As I said, you have to make him do the right things through love and explanation. And for that, you have to believe love is the most important thing in life. If you do, you will have all the time and patience to shower love on your child and explain things to him.

Cirular no. 17/2010
Finally the cat is out of the bag. A circular issued in 2007 after so many twists and turns has come into life.
The Transport Commissioner Chennai has issued circular no. 17/2010 which says that w.e.f. 1.6.2010 the circular no. 23/2009 has comes into effect.
The circular no. 17/2010 gives time to these two things.
Replacing new vehicle for heavy categories
Virtual training of one month for instructors .
Building of 1000 sq ft has been given time till 30.9.2010 in cir. 16/2010
Solvency and using the public road is rescinded in cir.23/2009.
So all other things said in circular no. 43/2007 comes to life w.e.f.1.6.2010.
What we have to do if we have to conduct tests for driving schools?
RTO should certify that this school complies with circular no. 23/2009 and only after that a school is eligible for the test.
Till then no driving school is considered to hold a valid driving licence.

How to follow 43/2007
The Transport Commissioner's Circular No. 43/2007 has to take effect w.e.f. 1.6.2010, if no other postponement comes on 31.5.2010.
Among all the things, the most important is the number of candidates per driving school.
How to carefully check the number of candidates?
Open a Register, maintain a single page per driving school, per month.
In the register have the following columns. motor cycle/ l.m.v./ combination of both lmv and motor cycle/ heavy vehicles.
Under the columns write down the number of candidates, the maximum candidates per each section. for eg. under heavy write down 1 to 15 in numeral form.
As and when a candidate appears from that school round off 1, if two candidates come for the test round off 1, 2. So as and when the maximum number of candidates reached you can notice that the school has reached the maximum candidates.
Among all the things, the most important is the number of candidates per driving school.

Driving school New Guidelines 16/2010
The Transport Commissiner Chennai has issued new guidelines in circular no 16/2010 regarding driving schools.
A circular no 43/07 was issued briefing the facilities the driving schools must have.
Subsequently another circular no 23/2009 was issued withhelding certain conditions stipulated in the earlier circular.
Now circular no. 16/2010 has been issued fixiing 1.6.2010 as the date of implementing the guidelines fixed in 43/2007.
So the driving schools need not have as prescribed in circular no. 43/2007.
1. They need not possess the mandatory space of 1000 sq. ft. Time is granted for this
2. They need not produce the solvency for Rupees 3 lakhs as prescribed earlier.
3. There is no ban in using public road for training purposes.
Then what the driving school must have.
Vehicle:- The school must have a latest model of the vehicle (not more than 8 years of age)
Exhibiting the school details:- On the left side door of the vehicle the school details must be painted .
Instructor:- The instructor must be at least 10th passed.a minimum experience of five years in addition to a certificate course in motor mechanics or any other higher course.
Training:- The instructor might have undergone virtual training for one month either at the institute of Road transport Gummidipoondi Taramani or in the training school at Leyland, Namakkal.
Limits of candidates:- The number of candidates that can be trained by an instructor as given in circular no. 43/2007 has to be followed strictly.
The above conditions come into force w.e.f. 1.6.2010,

Banks for National permit - all India.
The Government have announced the various branches of State Bank of India where the fee for all India National permit has to be paid.
This can be seen in dorth.gov.in .
The fee is Rs.15000/-
The fee for authorisation is Rs.1000/- plus the usual service charge.
There is no late fee as in the previous system. The validity is one year from the date of issue. Even if there is delay we need not charge anything.
We have to issue fresh authorization as we do in the case of All India Tourist permit.
The columns that we have to print for All India national permit vary. This can be see inthe G O. available in the Central Government web site.

Lalit Modi.

Circular no. 12/2010
The recent circular by Transport Commissioner viz. 12/2010 casts a duty on the authority to issue the Registration certificate on the same day.
The points made in the circular are.
1. Paste the registration number details on the notice board on the same day by three p.m.
2. Paste a copy of the same in a separate register.
3. The Reg.certificate of the transport vehicles shall be given to the permit section on the same day and the permit should also be made ready.
4. The Reg.certificate of other vehicles shall be also made ready on the same day.
In a register where a copy of registration details are mentioned, please also note the date of dispatch by the side of the each number.

Any momentary triumph you think gained through argument is really a Pyrrhic victory: The resentment and ill will you stir up is stronger and lasts longer than any momentary change of opinion. One sincere and honest move will cover over dozens of dishonest ones. Open-hearted gestures of honesty and generosity bring down the guard of even the most suspicious people. Once your selective honesty opens a hole in their armor, you can deceive and manipulate them at will. A timely gift – a Trojan horse – will serve the same purpose.

When Asking for Help, Appeal to People’s Self-Interest,
Never to their Mercy or Gratitude
If you need to turn to an ally for help, do not bother to remind him of your past assistance and good deeds. He will find a way to ignore you. Instead, uncover something in your request, or in your alliance with him, that will benefit him, and emphasize it out of all proportion. He will respond enthusiastically when he sees something to be gained for himself.

Pose as a Friend, Work as a Spy
Knowing about your rival is critical. Use spies to gather valuable information that will keep you a step ahead. Better still: Play the spy yourself. In polite social encounters, learn to probe. Ask indirect questions to get people to reveal their weaknesses and intentions. There is no occasion that is not an opportunity for artful spying.

Crush your Enemy Totally
All great leaders since Moses have known that a feared enemy must be crushed completely. (Sometimes they have learned this the hard way.) If one ember is left alight, no matter how dimly it smolders, a fire will eventually break out. More is lost through stopping halfway than through total annihilation: The enemy will recover, and will seek revenge. Crush him, not only in body but in spirit.

Use Absence to Increase Respect and Honor
Too much circulation makes the price go down: The more you are seen and heard from, the more common you appear. If you are already established in a group, temporary withdrawal from it will make you more talked about, even more admired. You must learn when to leave. Create value through scarcity.

Keep Others in Suspended Terror: Cultivate an Air of Unpredictability
Humans are creatures of habit with an insatiable need to see familiarity in other people’s actions. Your predictability gives them a sense of control. Turn the tables: Be deliberately unpredictable. Behavior that seems to have no consistency or purpose will keep them off-balance, and they will wear themselves out trying to explain your moves. Taken to an extreme, this strategy can intimidate and terrorize.

Do Not Build Fortresses to Protect Yourself – Isolation is Dangerous
The world is dangerous and enemies are everywhere – everyone has to protect themselves. A fortress seems the safest. But isolation exposes you to more dangers than it protects you from – it cuts you off from valuable information, it makes you conspicuous and an easy target. Better to circulate among people find allies, mingle. You are shielded from your enemies by the crowd.

A recent circular from Transport Commissioner has informed that for issue of authorisation instead of verifying the certificates first, we may issue authorisation first and then verify 10% to 15% of certificates in case of any doubt.
A doubt may come to our mind what to do?
Since the instructions are clear we have to follow it in letter and spirits. No going back on this.
But we may ask the candidates to read a tamil magazine, confirm the ability to read and then proceed further.

Xylo as Maxi cab
The Transport Commissioner has granted permission to register the Xylo vehicles from the Mahindra stable as tourist maxi cab in circular no. 7/2010.
This year so far seven circulars have been issued till date.

B S IV - what it implies?
April First is associated with funny things.
But this April is known to be a red letter day in transport circles.
The Government of India in notification no. GSR 522 (E) dated 15.2.2008 has fixed April First as a day for implementaion of BS IV type to all cities and BS III to Rest of India.The Govt. has phased out BS III vehicles from major cities including Chennai and from 1.4.2010 for registration the vehicle must be BSIV compliant in case if it is a metro like Chennai, Bangalore, etc. In rest of India the vehicle must be BS III compliant.
So a Maruthi 800, Ford Ikon, certain GM Vehicles, cannot be registered in Chennai whereas vehicles like TATA SFC 407 which are BS II compliant cannot be registered elsewhere. The vehicles must be converted as BS IV type if it is to be registered in metros like Chennai and BS II vehicles must be made as BS III if it is to be registered in other places.
We will have pollution free roads, in the near future.

Composite tax for Pondy
The Government of Puduchery has raised the composite tax due for National Permit vehicles from Rs.2000/- to Rs.5000/- w.e.f. 1.1.2010.
In other words it means that Pondy based National Permit vehicles have to pay the same amount to Tamil Nadu.
So when we happen to check the National Permit vehicles of Pondy State we have to collect the difference of tax if they have not paid the full tax of Rs.5000/-
Concession of 25% is applicable to multi axle vehicles. So if the vehicle is a multi axle vehicle then they need to pay Rs.3750/- only.

Height Matters.
In Karnataka recently 200 Motor Vehicles Inspectors were selected and out of it 40 candidates were refused appointment orders because their height is less then 167 cm. The fixed height for a person to be appointed as a Motor vehicles Inspector is 167 cm.
All the 40 candidates moved the Karnataka Administrative Tribunal.
The Tribunal in its order dated 2.3.2010 has directed the Transport Department to issue orders to all the applicants . In its order the Tribunal has observed that height is not going to do anything with their duty. So a cm less or more will not have any adverse effect in their function. So the Tribunal directed the Department to absorb all the candidates and directed it to seek relaxation from the provision which specifies the height.

However you call it , Rang, Colour, Hues, it denotes the same. Under M V Act and Rules, there are various Rules that deals with colours.
Rule 348 TNMVR:-
Lorries to be painted in highway yellow in front and rear
Goods vehicles carrying dangerous goods shall be painted red in colour and a lamp on top of the cabin in yellow colour has to be fixed.

Tractor and Trailer agriculture purpose - bus green
349-A:
School or college vehicles shall be painted in highway yellow and in front and rear on both exterior sides a circle in dark blue colour with yellow background with the words school buses inscribed on it.

The Minister knows pretty well that such a thing does not exist. Any how he visited each and every place in his kingdom to find out the thing. Nearly the days have lapsed and in the final week he met an old man who was selling old things and told him his problem. He smilingly took away a gold ring and scripted some words in the ring and gave it to the minister.

Omni Bus - All India - Collection of tax.
The Transport Commissioner, Chennai has issued instructions recently regarding collection of tax for All India Tourist omni bus.
Already there are several circulars and this recent instructions are nothing but the repeat of the same. Especially circular no. 44/2001 and 39/2004 relates to this.
44/2001 is a circular which carried the judgement copy of the High court which upheld the G O Ms. 1122 dated 10.7.92.
39/2004 is a circular which deals with the modalities of collection of tax for All India Omni bus.
The modalities contemplated in the circular are.
1. The tax should be paid at the border check post of the Transport Department only.
2. No advance payment should be made.
3. If the tax is not paid at the border check post but collected enroute by the Motor vehicles Inspector then the tax and the 100% penalty amount has to be collected. For eg if the tax is collected for 7 days then 1/10th tax and the equal amount of penalty has to be collected. But if the tax is collected at the border check post, the actual tax alone will do.
In other words it means that the vehicle has entered without payment of tax from check post to the place of check and for that 100% penalty is payable.
Transport Commissioner has reiterated the above in his latest instructions in A4/556/2010 dated 22.2.2010.

Govt. servant - Court Ruling.
Recently the High Court Chennai has dismissed an appeal filed by a Government Servant in a suspension case.
One Balachandar was a clerk in Education Department and was arrested by vigilance department for corruption charges.
He was placed under suspension under Rule 17(e) of the Tamil Nadu civil services (D & A) Rules..
He filed a writ petition challenging the suspension order.
The court ordered that reinstating a Government servant in service who was arrested in a corruption case before the trial is concluded is unthinkable . The Judge also ruled that Suspension order is in consonance with Article 14 and 16 of the Constitution.

N C P vehicles - penalty amount Specified.
There has been lingering doubt about the penalty amount to be collected in respect of N C P vehicles and the Transport Commissioner has issued a clarification in this regard.
The Transport Commissioner has issued a clarification in his letter no. A5/18673/2009 dated 24.2.2010.
As per this letter for N C P vehicles the penalty amount has to be collected as follows:-
within 15 days after the stipulated period:- 1/16th of the tax amount
more than 15 days but within 45 days:- 1/4th of the tax amount.
More than 45 days i.e. after the quarter:- 1/2 of the tax amount .
From this we can understand that for n.c.p. vehicles the penalty to be calculated is 50% of the tax amount. i.e. Rs,.2400/- + Rs.1200/- if the payment is made after the quarter, i.e. beyond 90 days .
It is also mentioned in this letter that if a vehicle is found plying without permit then the compoundding fee to be collected is Rs.5000/-
In offices where penalty is not calculated as per the clarification, we have to prepare a list now and collect the penalty when the vehicle owner comes for payment tax now .

Bilateral Tax.
There are varieties of tax payable under Tamil Nadu Motor vehicles Taxation Act 1974, and one such tax is Bilateral Tax.
Bilateral tax is paid on annual basis.
The vehicles which are covered by countersignature of permit to ply from another neighbouring State to our State has to pay such a tax annually.
The last date for payment of this tax is 15-4- of every year. The penalty for not paying this tax is Rs.100/- every month. If a person failed to pay this tax before 15th April and comes in the first week of May to pay tax then we have to collect penalty of Rs.200/- along with the tax.
If the tax is not paid then we have to issue demand notices to the owners of the vehicles and after the formalities are over send a note to State Transport Authority Chennai to cancel the countersignature.
Once the countersignature is cancelled, then they need not pay the arrears for the vehicle.
Please refer circular no. 15/95.

Act No.13/2003 w.e.f. 1.8.2003 has introduced several new taxation slabs . One among them is revision of tax for Educational Institution vehicles at Rs.150/- per seat per quarter.
Subsequently the Supreme Court in a special leave petition filed by various schools and colleges and their associations has ordered interium stay in so far as the arrears of tax is concened. Govt have introduced Act No.9/2007 thereby reducing the tax to Rs.50/- per seat per quarter to schools and Rs.100/- per seat per quarter to colleges.The Supreme Court in its order has stated that tax at the new rate to be collected from Dec.2006 onwards.
The Transport Commissioner has in a circular 11/2007 has issued guidelines for collection of arrears of tax prior to Dec.2006.
The stay order for collection of arrears of tax is applicable to the associations which filed the suit. If any educational institution is a memeber of such association then the school / college also gets the benefit of the stay order. In other words the schools/colleges which are members of the associations that filed the writ in the supreme court are covered by the stay order.
In other cases the arrears has to be collected.

2. L I C Policy
3. Pass port
4. Pay slip issued by the Govt or local body
5. any other document or documents as may be prescribed by the State Govt. u/S of 28(k) of the
Motor vehicles Act.
6. Proof of legal presence in India in addition to proof of residence in case of foreigners.
If you notice keenly RATION CARD HAS BEEN OMITTED as an address proof by amendment in notification in GSR 589(E) dated 16.9.2005.

Licence to Foreigners..
Nowadays in most of the colleges foreign students are studying and in many automobile companies, many foreigners are working.
They require licence to drive their vehicles as vehicles have become a part of their life.
Can they be issued with a driving licence?
The Central Government have amended the C M V Rules in the year 2007 in GSR 276(E) dated 10.4.2007 . In that amendment a provision has been inserted to Rule 4 of the C M V R 1989 namely Rule 4 (12)
4(12):- Proof of legal presence in India in addition to proof of residence in case of foreigners.
This means the foreigners have to produce a copy of visa issued by the Indian Government along with an evidence for their residence, viz. an affidavit etc.
If they produce the documents as enshrined under Rule 4(12) they may be issued with a driving licence.

No Green Tax for Govt. vehicles.
G O Ms 649 Home Dated 31.7.2003 introduced Green tax.
Whether such green tax is applicable to Government vehicles?
Green tax is an additional tax levied under Section 3 of the Tamil Nadu Motor vehicles Taxation Act 1974.
G O Ms. 862 Home Tr.I Dept. dated 31.3.1979 exempts the vehicles of all the non commercial departments of the State Government from payment of any tax under the TNMVT Act .
Hence the vehicles belonging to non commercial Dept. of the State Govt need not pay the following taxes:
Regular tax
Greent tax
Road safety tax at the time of registration.

Interesting Court cases.
Certain cases makes an interesting reading.
It is the dictum of lawyers to argue the facts when law is weak and argue law when facts are weak. It is only sheer legal acumen that wins a case. Lawyers need keen observation, to note finer points, to prepare the defence in several ways.
One such case happened in pre independent days. In London many Indians studied Law and practised law. Nehru, and Jinnah were famous lawyers in those days in London.
In those days there was a rule in England that none should have anything that the Queen possess. If Queen has something special no body should copy it. There was a rich man who wants to have chariot as that of the Queen. A Chariot drawn by five horses. So he made a chariot as exactly as that of the queen. The same color, the same length, the same seat the same type of horses.
When he was happily riding on the Streets of London, the guards from Buckingham palace caught hold of him and filed a case against him, the offence being he used the same chariot as that of the queen and thus denigrated the queen.
The case came up before a London Court and for the rich man , Jinnah argued. Jinnah showed the photos of two chariots one that of the Queen and another that of his client.
He argued in length that the height is the same, colour is the same, seat is the same, wheels are the same and everyone wondered whether he is arguing for his client or for the Queen.
Suddenly he showed the photos of the horses and argued that though the colour of the horses are also the same, the queen had five female horses(mares) to draw her chariot where as his clients chariot had two mares and three horses. i. e. two female horses and three male horses. So it cannot be concluded that both the chariots are same .
The Judge accepted the argument dismissed the case and allowed the rich man to ride his horse drawn chariot, to run in the streets of London.

There was a rich man who wants to have chariot as that of the Queen. A Chariot drawn by five horses. So he made a chariot as exactly as that of the queen. The same color, the same length, the same seat the same type of horses.
When he was happily riding on the Streets of London, the guards from Buckingham palace caught hold of him and filed a case against him, the offence being he used the same chariot as that of the queen and thus denigrated the queen.
The case came up before a London Court and for the rich man , Jinnah argued. Jinnah showed the photos of two chariots one that of the Queen and another that of his client.
He argued in length that the height is the same, colour is the same, seat is the same, wheels are the same and everyone wondered whether he is arguing for his client or for the Queen.
Suddenly he showed the photos of the horses and argued that though the colour of the horses are also the same, the queen had five female horses(mares) to draw her chariot where as his clients chariot had two mares and three horses. i. e. two female horses and three male horses. So it cannot be concluded that both the chariots are same .
The Judge accepted the argument dismissed the case and allowed the rich man to ride his horse drawn chariot, to run in the streets of London.
So observation plays a key role in Life.

When a vehicle can be Detained.
The Transport Commissioner has issued several circulars regarding the detention of a vehicle. Seizure of Registration Certificate is alone enough in some cases.
In the following cases the seizure of Registration Certificate alone is enough
1. driving without valid driving licence
2. plying without permit.
If the original Registration certificate is not available at the time of check, then the vehicle could be detained in the above cases.
In case if the vehicle is found plying
1. without registration
2. without valid fitness certificate
3. without tax
then the vehicle can be detained . Refer circular 10/92 and 54/92
Release of vehicles is separately dealt in circular no. 31/2001.
In the following cases the seizure of Registration Certificate alone is enough

Driving Schools - Guidelines.
The Transport Commissioner, Chennai has issued guidelines regarding the establishment of driving schools in circular no. 43/07.
Against this many moved the High Court and the High Court has given its judgement on 28.10.2009.
Based on the above judgement the Transport Commissioner Chennai has given an another Circular in 23/2009.
As per this circular the existing driving schools have time up to 31.5.2010 to change according to the guidelines in 43/2007., except in two items . 1. Solvency certificate. The solvency certificate for three lakhs need not be insisted upon for the existing schools. 2. training in public ground. Initial training can be conducted in an open ground.
Now what we have to do?
We have to inform all the driving school owners that the existing driving schools should adapt as per the standards fixed in circular no. 43/2007. , on or before 1.6.2010.
It includes tools, vehicle model, building etc. This intimation should be sent to them well in advance. Any renewal of driving school permit can be done up to 31.5.2010, with the existing facilities.
But for the issue of new driving school permit, the conditions stipulated in circular no. 43/2007 applies in full.

Re. Registration guidelines.
Transport Commissioner Chennai, has issued guidelines for re.registration in Circular No.110/96.
The features of this circular are:-
1. Immediately on receipt of application address the O R A for confirmation of N O C. In case of Kerala based vehicles, the details can be ascertained from the website of that office.
In other cases, confirmation of N O C may be obtained through post. We may serve the letter by the RPAD , wait for the acknowledgement and see to it that the reply comes through post. The cover of the confirmation letter is a vital document.
2. Simultaneously we may address the Crime Records Bureau Chennai for N.O.C.from their end. In case if the vehicle is a stolen vehicle, the details could be ascertained from the department.
3. If no reply is received we may remind the O R A again by RPAD.
4. If confirmaion is received we may process the application. Under no circumstances the confirmation letter produced by the party need to be accepted.
5. At the time of submission of the application the vehicle must be inspected and address of the owner should be verified .
6. If the vehicle is a transport vehicle, the means of travel from other State must be ascertained. If it is by road, we may request him to produce a copy of the temporary permit issued at the check post or if it is by means of another vehicle, then the lorry receipt may be verified.
No haste should be shown in re.registering the vehicle . Tax on ulw for the period should be collected at the time of presentation of the vehicle.

Marie Curie
Marie Curie and her husband Pierre Curie shared the nobel prize for physics in 1903.
In 1901 again Marie Curie was awarded the Nobel prize for Chemistry.
Her daughter Joliot also won a Nobel prize in Chemistry.
When Marie was a young girl she wished to become a Doctor. Her father told her that her elder sister Pronja wanted to be a Doctor too and he could not send both his daughters to medicine as he was not well off. Marie told her father that she would work and earn money and help her sister and her sister should help her once she finished her studies. Her sister left for France to study medicine and after that she helped Marie to study medicine.
In Paris Marie lived like a monk in a sixth floor attic where everything was in scarce. She used to eat bread and tea and egg was a luxury to her.
Later on she married Pierre Curie and discovered Radium. At that time the radium was $.1,50,000/- per gram. Everyone suggested Marie to patent radium, so she could earn more money. Marie told her friends that Radium is for the world and not for her.She did not patent it and everyone produced radium.
Marie never liked any medals or awards. She only kept the menu card that comes with the invitations as it is made of thick cardboard and she could make mathematical calculations on it.
When everyone wanted Marie to write about her life history she replied in simple terms. Marie was born in Warsaw, married Pierre and had two children.and worked in France.

Registratin Documents.
What are the documents required for Registration ?. Though we know most of the things, at times we miss the finer points like
1. Entry tax paid certificate from Commercial Tax Authorities, in case if the vehicle is purchased outside Tamil Nadu. Especially this applies to vehicles like constructions equipment vehicles , cranes, rigs, forklifts, etc.
2. In case of trailer, design approval from State Transport Authority.
3. In case of a construction equipment vehicle, the overall length and other measurements must be in confirmity with Rule 93 of the Central Motor vehicles Rules 1989. If it exceeds, then the permission of the Government is must.
4. Customs clearnance certificate in case of foreign vehicles.
Other things as usual.

Colour of Three wheelers.
G O Ms 1661 Home Tr. III Dept dated 12.11.07 has pointed out how an Auto not covered by permit should be painted.
Rule 364-A of T N M V R 1989 specifies that every autorikshaw not covered by contract carriage permit should be painted in sky blue colour and also the words "Not for Hire " should be painted in a conspicuous place of the vehicle both in front and back.
Refer Letter of Transport Commissioner no. 67563/B4/07 dated 14.11.07

Reflectors
The Government of India, in its notification GSR 5944(E) dated 12.11.08 has stated that Rule 104 of Central Motor vehicles Rules 1989 has been amended so that the Reflectors has to be fixed in the vehicles and it has become mandatory.
The following are the specifications .
The Goods vehicles which are registered on and after 1.4.2009 shall be fixed with reflectors .
The passenger vehicles including Autos, Taxis, buses, maxicabs shall be fixed with reflectors which are registered on and after 1.10.2009.
In other words it means when a vehicle is brought for registration, the fixation of reflectors are must.
The Transport Commissioner in his letter No. 52738 /H2/ dated 30.10.2009 has also communicated the above notification.

Omni Buses - Enter the Eng. No and Ch.No.
To prevent tax evasion and illegal operation of omni buses the Transport Commissioner Chennai has suggested that the engine number and the chasis number of the vehicle must be entered in the permit and the permit details must be entered in the Registration Certificate of the vehicle.
The Regional Transport Officers, in whose offices these DCB Registers are maintained for omnibuses shall enter the above detail.
So that the engine number and the chasis number could be easily verified in case of doubt and there would be less chances of interchanging the vehicle and also the same number displayed in several vehicles.

Though most of us know the Motor vehicles Rules, the relevant Rule fails to come to our active memory suddenly.
So a glimpse of certain important provisions in the Act and Rules.
1. Helmet Must: Section 129 of M V Act.
2. More than 2 persons in motor cycle: Section 128(1) of MV ACT
3. Failure to stop the vehicle
during a course of check:- Rule 21(12) of CMVR r/w Section 184 of M V ACT
4. Power of RTA to restrict the permit: Rule 165 of TNMVR
5. No person on top of the goods vehicle. Rule 238 of TNMVR
7. Foreign vehicle Registration. Rule 47(h) of CMVR
8. Trailer length: Rule 350 of TNMVR
9. First aid box medicines Rule 172(5) of TNMVR
10. Duplicate FC to be signed by the one who issued
the original FC Rule 124 of TNMVR

Fancy Numbers.
The Government have reserved 96 Fancy Numbers that have to be allotted by the Government in G O. Ms.209 Home Dated 27.1.90.
When a Registration serial is nearing completion, we may found there are many numbers in the Reserved category that were unallotted like 11,111,1111, 6666 7777, etc.
In such cases what to do?
The Government have issued clear guidelines in this regard in G O. Ms. 890 Home Dt 27.5.92.
Transport Commissioner has also issued a circular No.106/92 in this regard.
The unallotted fancy numbers which were reserved by the Government should be allotted in the ascending order after exhausting all the numbers in the current series without collecting any fee for the advance number and only on allotting the unutilised numbers the next series can be started .
A question may arise as to whether any number which is not reserved by the Government can be allotted in the next series before completion of this current series.
The Reg.Authority can allot in next series even before completion of this current series if the number sought for comes within 1000 numbers.
For eg. if in a particular office The series A is nearing completion and already the number 9546 has been allotted in the routine way, the Authority can allot in B Series up to 0545 , provided if the number is not reserved by the Government

N.P.Concessional rate for Multi axle vehicles
The composite tax payable by this State vehicle for other States is Rs.5000/- In case of multi axle vehicles, the tax is paid with a concession i.e. 25% less then the usual Rs.5000/- which means Rs.3750/-
The Transport Commissioner has issued a circular in this regard in the year 1998 namely 32 / 98 in which it is informed that concessional rate of tax of 25% is allowed for multi axle vehicles for other states if other States too reciprocate this.
If the other State also allows 25% concession for multi axle vehicles of our State, then the same can be extended to other States .
The Transport Commissioner in his letter No. M2/67895/09 dated 18.12.2009 has again reiterated the same and has informed that for Karnataka State also this concession applies. So if a vehicle of this State has got authorisation to ply in Karnataka State then Rs.3750/- is enough if it is a multi axle vehicle .

Driving School permit - Transfer.
Transport Commissioner, Chennai has issued a circular viz. 25/09, in which it has been pointed out that after the death of the owner of a driving school , the licence granted to the owner could be transferred to the legal heirs.
The circular further states that if the legal heir fulfils the qualifications as laid down under Rule 24 of the Central Motor vehicles Rules, then there is no bar in transferring the licence to the legal heir.
The High Court Chennai in its judgement in W P no. 29797/08 has observed that the Licensing Authority shall examine the claim of the legal heir , and if the legal heir fufils the qualifications, then the licence could be transferred.
So the Authority which granted the licence could consider if such a request comes to them.
The points for consideration is
a. What is the fees to be collected for such a transfer. Since no fees is prescribed for transfer, we have to collect the fee prescribed for issue of licence.
b. Whether the school should be as per new guidelines. Not necessary . We are not issuing any new licence. We only transfer the existing licence. So new guidelines will not be applicable.

A Better India - A Better World
You may all know Narayanamoorthy, the founder of Infosys. He has given lectures in all the leading colleges and has written several books.
His recent book is A better India A better World.
In this book he suggests six important points for youngsters to achieve greatness.
The six points are
1. Be trustworthy. If you do anything, with whomsoever you move, be trustworthy. Suppose you say that you would come to office only at 11.00. do come at the appointed time . If you come late in the afternoon, your boss may not believe you. Suppose you say to your wife that you would take her out, fulfil it without lame excuses. So be trustworthy. When some one loses confidence in you, that is all, no responsibility would be entrusted to you. We may lose lot of things when we are not trustworthy.
2. When you enter into a new deal naturally fear will crop up. Do not take it lightly. Brood over it, over come the fear and do the needful to accomplish it.
3. Never discard your family for your work. Whatever be the work, spend time with your family. Home is not a boarding place, just come, eat and sleep. You spend some time daily with the aged mother, lovely wife, wonderful kids. listen to them. Share the jokes, appreciate them, say thank you to your wife for the wonderful food. See the change in life.
4. Always do not bind you with your work. There is something more than work in life. Smile at friends, talk to them, spend time with them. When we fall down, we need some shoulders to rest. So give importance to work, at the same time take care of your family, relations, friends.
5. Try to control your feelings. Never express your anger to anyone. That will not only damage your reputation, but spoil your relationships, and we may create new foes in our field. You have to control yourself.If you want to administer an office,
6. It is true earning money is important. But that is not the be all and end all of life.You are only a temporary owner of the money you have. Try to use the money to educate a poor relative, a boy with no means may be given fees for school or college. Then the money is better spent.

Autorickshaws - Seating capacity.
The Government have introduced an amendment to Rule 309 of Tamil Nadu Motor vehicles Rules 1989 in G O Ms No.328 Home Trans.V dated 7.3.2008 regarding seating capacity for Autorickshaws.
The amendment is as follows:-
Provided further that for the purposes of these measurements for seating room of an Autorickshaw 5 children upto 14 years shall be reckoned as 3 passengers.
So at the time of granting permit we have to mention in the seating capacity column three passengers or five children up to age of 14 years.

Cancellation, Suspension of Dri.Licence.
When a Driving Licence can be suspended or cancelled.
What are the relevant rules for this?
Sections 19,20,21 and 22 of Motor vehicles Act deals with this.
Section 19 deals with the powers of Licensing Authority to disqualify a person for a particular period from holding a licence or revoke a licence for the offences noted in the same section and also in Rule 21 of Central Motor vehicles Rules.
Section 20 describes the powers of the Court to disqualify a driver for a particular period from holding a driving licence.
Section 21 describes when a licence can be suspended.
Section 22 contemplates the effect of conviction of a driver in a court of Law.
The nuances of Section 21 and 22 should be understood carefully.
If a driver is involved in a fatal accident his licence should be suspended for SIX MONTHS AUTOMATICALLY.
Likewise if a driver is involved in a fatal accident and if his licence has to be returned to him after the period of suspension, before the licence is returned the driver must undergo a driving test and pass the same. Only if he passes the test, the licence could be returned. See the proviso under Section 22(3) of Motor vehicles Act.

Cancellation of Registration.
Suppose if we came to know that a person has obtained a Registration Number by producing fake registration papers what to do?
Section 55 of Motor vehicles' Act 1988 provides relief for all such acts.
The Registration Certificate can be cancelled on the following grounds:-
a. If the vehicle is fully dismantled, scrapped and unfit for further use.
b. If the vehicle is removed to a foreign country once for all.
c. If the Registration certificate is obtained by production of false records or the numbers in the
engine or chasis varies with that of the records produced.or found to be tampered.
WHO CAN CANCEL:- The Authority who originally registered the vehicle can cancel the R.C.If the papers for cancellation are received by some other authority, the papers should be forwarded to the original authority for the cancellation process:
HOW TO CANCEL It has three steps
1. Inspection of vehicle
2. Notice to the owner informing the proposal for cancellation
3. Cancellation

Transport Commissioner in Letter No. 59541/H2/2009 dated 11.11.2009 has instructed that police verification report should be obtained only from

Chennai 600 028.
The above office alone is vested with powers to issue Police certificate.
In other words it means that we should not address local Superintendent of Police or Inspector of Police of local stations for issue of police certificates.

Transfer of Ownership.
Whenever an application for transfer of permit is made, both the buyer and seller must sign before the Authority.
The Authority should satisfy himself about the genuiness of the seller by verifying the photos of the RC/Permit etc.
The Transport Commissioner has issued a circular No.51/2003 in this regard. Rule 211 of T N M V R 1989 allows this.
The salient features of this circular are
a. That it appllies for transfer of permit.
b. Personal appearance is must.
c. Signing before Notary public is not permitted.
The other points in this matter are
1. After allowing the transfer of permit application if the applicant could not produce the records within the perriod but subsequently wants to effect the transfer, that can be permitted by collecting the fees.(Transport Commissioner memo No. 72144/E2/83 dated 29.11.1987)
2. If one of the parties wants to drop further proceecedings without effecting transfer, that can be permitted and the same should be informed to the other party . Rule 212 of TNMVR.
